Prabhat inducted into IPS | | | EARLY TIMES REPORT JAMMU, Sept 05: Ministry of Home Affairs, in a notification issued today, has ordered the induction of Prabhat Singh into IPS. He is allocated state cadre. His induction was cleared by President Pratibha Devi Singh Patil appoint Mr. Prabhat The appointment will take effect from the date on which his immediate junior in the select list of 2007 was inducted into IPS. It has been mentioned in the notification that Prabhat's appointment is in compliance with the May 31, 2011, order of Central Administrative Tribunal, (CAT), Chandigarh. The CAT had on May 31, 2011, ordered re-appointment of SSP Prabhat to IPS with effect from 2007 with all the monetary and service benefits. The order was issued yesterday by the Chandigarh branch of CAT after Prabhat moved application through his counsel, who had challenged the deletion of the applicant's name from the IPS select list of 2007 in pursuance of his superannuation in the meantime. Union Ministry of Home Affairs, Union Public Service Commission and Jammu and Kashmir through commissioner (Home) were respondents in the case. The core point of controversy was that whether the non-holding of the selection committee meeting at the appropriate point of time could defeat the claim of a state police service candidate just because he had superannuated in the meantime. After hearing the counsels, panel of Justice S D Anand and Khushi Ram, members of the tribunal, ordered re-appointment of Prabhat with promotion to the IPS against the vacancies available for 2007. Stating that non-convening of the meeting of the selection committee was an act solely attributed to UPSC, the CAT said that no blame for the delay, therefore, could be attached to the applicant, who was at serial No 1 in the zone for consideration for IPS.Quoting similar controversies, the tribunal quashed deletion of applicant's name from the list and ruled that Prabhat was entitled to be considered for appointment with promotion to the IPS against the vacancies available for 2007. The respondents were accordingly directed to consider the applicant for appointment by promotion to the IPS against the vacancies available for 2007.
