JKNPP pleads speaker to disallow resolution of Engineer Rasheed

JAMMU, Sept 7: Jammu and Kashmir National Panthers Party (JKNPP) leader Harshdev Singh has urged upon the speaker J&K legislative assembly to disallow illegal and technically deficient resolutions presented by a valley based legislator in the assembly seeking clemency for parliament attack convict Afzal Guru.
He said the proposed resolution, which seeks to nullify and invalidate verdict of the apex Court of the convict, in so far as execution of the convict is concerned, and further seeks clemency for convict is inadmissible under prevalent laws and norms and cannot be taken up for discussion in the assembly. He said that the resolution is not admissibly and has no value except for its sensational content and melodramatic value.
Singh said that the functioning of the assembly is governed by the rules of procedure and conduct of Business in the J&K legislative assembly. He said that if a resolution, motion inadmissible and can neither be taken up for discussion nor is the voting allowed on such matters. Harshdev Singh further clarified that a private members resolution in order to be admissible must fulfill the conditions laid down in Chapter XII of the Rules of procedure and conduct of Business in the J&K legislative assembly and the eligibility requirements laid down in Rules 175,177,178, and 180 of the said Rules.
Harsh Dev Singh further pointed out that the proposed resolution suffers from the defects of vagueness and ambiguity the language of the resolution says alleged involvement of Afzal Guru in parliament attack. He said that the language used by the mover of the proposed resolution is further contemptuous of the Supreme Court which though has held the accused guilty but the mover says it is alleged involvement
Harshdev Singh said that in view of inherent defects in the resolution and non- fulfillment of the eligibility conditions as laid down under law. He said that resolution if allowed despite, legal infinites could create instability and jeopardize peace besides setting bad precedents. He said that people must have faith in judicial system and in the unbiased dispensation of justice by the constituently of the country
