As CM assured protection, Police cashier grabbed migrant land | Authorities `facilitate' systematic land grab in Muran | | Early Times Report JAMMU, Sept 7: The promises of the Chief Minister regarding protection of migrant property notwithstanding, a cashier of the police department has the gut to annex residential land owned by a migrant at Muran, Pulwama. The district administration and the concerned police chief have been apprised of the land grab and urged to take necessary action. However, the cashier seems too strong for them. The land grab continues slowly but surely as the authorities watch helplessly. The owner informed the concerned deputy commissioner through a fax on August 22, 2011. The receipt of the fax was acknowledged Abdul Rashid, DSP, HQ. However, nothing moved. According to the complainant, not a a single constable visited the spot to find the facts and stop the culprit from further encroachment. On August 22.Ghulam Rasool Dar, Addl. SP, Pulwama was contacted, who in turn instructed Abdul Rashid, DSP, HQ to look into the matter. Rashid assured on 23.08.2011 that the complaint had been marked to SHO, Pulwama. He assured that not even 6 feet of land would be allowed to be grabbed and whatever might have been illegally constructed on the land would be demolished immediately. Yesterday, Abdul Rashid was contacted on his cell phone several times to know the FIR No. and the action taken on the ground, but there was no response at all. It has been reliably learnt that the Patwari and Naib Tehsildar visited the site on 24.08.2011 at 5pm and were provided factual figures by Badri Nath Bha. It is also learnt from reliable sources he was confronted and overawed by one Mushtaq Ahiangar who is supporting Mr. Ali Kumar to grab our land. Despite this visit Ali Kumhar got the illegal construction work expedited by his brother-in-law and got erected 10 feet wall on our land to annex part of our land with his land, in next two days. Ali Kumhar has got approximately 15 Marlas of land in exchange from Late Ghulam Qadir Mir in the neighbourhood of the land being grabbed. Out of the said land around 4½ Marlas has been usurped by Gani Khar, another neighbour and now Ali Kumhar instead of challenging Gani Khar is encroaching on the migrant land. It is also learnt that Mushtaq Ahiangar, and Gani Khar, the two Neighbours are instigating and conniving with Ali Kumhar and all of them are having an evil eye the land. All the trees have been cut on our fenced boundary wall. The wood has been removed and concealed by Ali Kumhar to efface the evidence of the criminal offence of house trespass and theft, in contrast to a similar act of encroachment led by Mouidin Mir in 2006 when Miraj Kakroo, then DC, Pulwama directed the wood of the cut trees to be handed over to Mr. Ratan Lal, a local resident, on Supurdnama. A copy of the complaint has been sent to the Governor of Jammu Kashmir, Chief Minister and the the Divisional Commissioner Kashmir. The owner has urged them to get an FIR registered against the erring police cashier. The owner has also produced communication dated December 12, 2006 to remind the authorities of their failure to take appropriate action to prevent the land grab. A communication addressed to SP reads: "In continuation to our complaint cum FIR to you dated 10.12.2006, to which your acknowledgement/confirmation to the registration of FIR is still awaited, it is learnt today in the afternoon the same person namely Mr. Mohi-ud-Din Mir S/o Late Mr. Gh. Qadir Mir of Murran has removed the evidence of the crime by pulling out the remained roots of the cut trees on our land with the help of a bulldozer. It is obvious that your department has not taken any action on our aforesaid FIR, which has emboldened him to commit further crimes. We would request you to let us know exact circumstances under which the culprit has been emboldened to commit further crime to the extent of even removing the evidence of the earlier crime." Another communication addressed to MA Kakroo the then District Magistrate of Pulwama. "Despite your assurance that nobody will be allowed to encroach on our land in Murran, it is learnt sadly that the same elements who first cut down our poplar trees on 8th , 9th and 10th Dec. 2006, today in the afternoon have entered into our premises and destroyed the evidence of the existence of these very trees on our land by removing the tree-roots with the help of the bulldozer. The intentions of these miscreants are very obvious to destroy the evidence of the crime committed by them by cutting the trees on our land and then grab it and even to damage our lone existing outhouse rented out to Ellaquai Dehati Bank by us", the communication reads. On 12/10/06, Meraj Kakroo responded. Dear Bhat Sahib, Recieved Ur E-mail and took prompt action. Tehsildar Pulwama was sent to site who reported that Aastaan committee Muran had decided to clear encrochment on the Khul to pave way for smooth flow of water and construction of bathrooms. In that persuit they have cut some trees which are reportedly in Govt. land. The cut trees have now been kept under supurdnama of chowkidar and one local pandit Shri Ratanlal. Tehsildar has been asked to assertain the revenue record and in case of any violation take stern action. Be assured that nobody will be allowed to encroch on our land." The assurance did no good to the aggrieved owner. Another Email was sent. "Dear Sir, Yesterday evening it was learnt that an unauthorized/illegal grabbing of our residential Property/Land at Boni Bagh, Village Murran, Tehsil Pulwama is being planned by some anti-social elements / miscreants led by Mr. Muheedin Mir Ex-MLA of National Conference. It is the same Ex-MLA whose father Late Gulam Qadir Mir forcefully occupied our religious pond (BHAWAN) in front of our Residential LAND mention of which was already made on 13th Dec. 2004 in my earlier complaint (copy enclosed) to you for preservation and protection of our property. These miscreants have already cut many poplar (safeda) and willow trees on our land and are now planning to grab the whole land on which once a huge ancestral house existed till 26th July 1995 which was gutted into fire by these miscreants in the name of terrorism. It would be appropriate to mention that we lost because we did not yielded to the threats and pressure tactics of these miscreants to sell off our residential property/land. And now they are taking law in their own hands by illegally grabbing it." As the distressed owner awaits justice, the authorities have been giving assurances. But can mere assurances prevent the land grab? |
