PIL on pollution: DB issues notice to CS, | SPCB chairman, JMC commissioner, DC | | EARLY TIMES REPORT JAMMU, Sept 08: A high court division bench of Justice Virender Singh and Justice Hasnain Massodi, in a PIL filed about noise and air pollution generated by the use of non-biodegradable material including polythene carry bags, has issued notice to the state through chief secretary, state pollution control board chairman, JMC commissioner and deputy commissioner, Jammu, returnable within four weeks. The DB ordered that in case the service was complete within the aforesaid period, the case be listed immediately thereafter. The division bench observed that the instant petition prima-facie espoused public interest at large, which called for indulgence of this court to have the stance of the respondents on record apprising the court as to what necessary steps had been taken by them in order to implement the provisions of the acts. The acts included Environment (protection) Act 1986, Provisions of Plastic Waste (management and handling) Rules 2011, the Municipal Sold Waste (management & handling) Rules 2000 and Jammu & Kashmir Non-Biodegradable material Act 2007 and rules made thereunder.
