| Court accords bail to 4 accused for possessing fake currency | | | Jammu, Dec 04 Additional Judicial Magistrate Jammu Mohd Rafiq Chak today accorded bail to four Kashmiri youth, who were arrested by police allegedly with fake currency notes of rupees Rs 1, 05,000. Report filed by police revealed that Rs 1, 05,000 were recovered from the possession of one of the accused Fiaz Ahmed S/O Abdul Rehman, when he was moving in suspicious circumstances. On his interrogation, he disclosed the name of other three accused all hailing from Kashmir Valley. However no computer or scanner was recovered from the accused and they are only to have been in possession of fake currency. After listening arguments from both prosecution and defence lawyer, Advocate Firdous Ahmed Tak, the Magistrate accorded bail to the all four accused. While issuing orders of the bail, Additional Judicial Magistrate observed that it is obvious that offence u/s489-B is punishable with imprisonment for life or ten years and is a heinous offence. At the same time, it is not the heinousness of the offence which is only criterion for granting or refusing bail and where alternative punishment is provided; the lesser one is to be taken into account and in such a case bail is not forbidden. Since the accused are not involved in an offence punishment of which is death or imprisonment for life and since investigation is complete in all respects, denying bail to them will amount to punishing them before launching trail against them. |
