Defer resolution on Guru for regional amity | | | Was it necessary for MLA, Er Rashid, to decide in favour of moving a resolution in the state Assembly seeking the nod of the House for getting the death sentence awarded to Afzal Guru commuted ? Constitutionally it was not necessary because a resolution adopted by a State Assembly does not make it mandatory for the Government of India in general and the President of India in particular to accept resolution and implement the recommendations. Politically it was needed not only for Er Rashid but for all the Kashmir centric political leaders. It was this very political compulsion which had prompted Chief Minister, Omar Abdullah,to tweet when the Tamil Nadu Assembly adopted a resolution seeking conversion of death sentence into life imprisonment to the killers of Rajiv Gandhi. And when the Tamil Nadu Assembly adopted the resolution it was neither greeted with protest demonstr ations and jeers nor with any support. And Omar Abdullah was right when he, in his tweet, posed a question seeking to know whether the resolution, if adopted, on Afzal Guru received as muted a reaction as the Tamil Nadu Assembly resolution on Rajiv killers received. He seems to be right in his assessment because his tweet received adverse and loud reaction from various political leaders in the country including in the Jammu region.It is quite evident that both Er Rashid, by planning to move a resolution seeking Assembly's nod for getting commuted the death sentence awarded to Afzal Guru,and Omar Abdullah, by his tweets, wanted to draw a political mileage from their opposition to the capital punishment to the one who belongs to Kashmir, irrespective of the fact that Guru has been accused of materminding the terrorist strike on the Parliament building in 2001 in which 12 people,including one civilian were killed. That Guru had become a hero in the eyes of anti-India forces in Kashmir and hence Kashmir centric political leaders wish to regain the ground they had lost by supporting clemency for Guru. If Er Rashid's resoluton is tabled for discussion and vote in the state Assembly it may ultimately expose the skin deep relations between the Congress and the National Conference since indications are that the majority of legislators belonging to the Congress may not support the resolution unless the party high command has something else in its mind. Secondly the very debate on the resolution may trigger regional divide among the legislators because MLAs belonging to the Jammu region have been aware of the strong reaction Omar's weet received from the region. If the Congress, which has 17 MLAs, decides to oppose the resolution it is likely to get full support from the 11 BJP MLAs and three Panthers Party legislators.That way it may not be easy for the National Conference and the PDP to muster support for the resolution. But that may not be important either for Er Rashid, or for the PDP or for the National Conference. For them the important thing is their simple support for the resolution. Those among the NC who are planning to vote for the resolution need to remember that the Yamuna in Delhi was not set on fire when the Assembly adopted a resolution favouring restoration of greater autonomy to Jammu and Kashmir. Though the resolution was sent to the centre for action there has been no response from the Government of India during the last over a decade. It would be better for the speaker, who is known for his political wisdom, to delay tabling of the resolution in the interest of regional amity. |
