| DB issues notice to chairman UGC | | ‘Illegal off-campus centers’ case | |
Jammu, Dec 04 The Division Bench of Jammu and Kashmir High Court today issued notices to Chairman University Grants Commission, Chairman Distance Education Council, Vice Chancellor Vinayaka Mission Research Foundation Salem Tamil Nadu and others for illegally starting off campus courses and directed them to send their replies one week before the next date of hearing. This direction was passed on a number of representations made to the Chief Justice, which were treated as PIL. The DB comprising Chief Justice Mr. B A Khan and Justice J P Singh also directed Registrar Judicial, Jammu Wing, to supply copy of representations to all these authorities and seek their reply/ response. Junior Engineers of various Works Department in their representation has brought in the notice of Chief Justice that alleged fraud is being perpetuated by the Deemed Universities by running illegal off-campus centers in B Tech, BE Courses in various branches, particularly by Vinayaka Mission Research Foundation, Salem, Tamil Nadu, by shear gross misrepresentation of the facts to the students, the said university has not only amassed crores of Rupees from the poor, gullible students of J&K State, but has jeopardized the career of the students by handing them over legally untenable and invalid degrees. In the representation it has been submitted that UGC in its circular issued on August 23 last year has made it amply clear to such institutions to seek specific approval of the UGC and the State Government where such centers are proposed to be started and Distance Education Council’s clearance is mandatory .The representation further said that UGC has not approved study center of any of the deemed universities including Vinayaka Mission Research Foundation, Salem, Tamil Naidu. In another notice/ circular issued on January 5, 2006 by Distance Education Council it has been made clear that the deemed universities are not permitted to offer Distance Education outside the state of their location and private study center as franchising is not permitted. In the representation it has been submitted that being Technical Courses in Engineering B.Tech/ B.E, no approval from Academic Council of Technical Education J&K State and AICTE has been granted to these centers. In this regard it has been mentioned that certain in-service students (Diploma holders) who enrolled themselves with particular deemed University last year in mid 2005 have already obtained Degrees from this University by appearing simultaneously for two semester exams at a time thereby clearing the degree in three sittings within one and half years making a mockery of the whole education system. Such candidates as well as some other candidates of such deemed universities have submitted their cases to the authorities for consideration of promotion to Degree Engineers. In the PIL it has been prayed that in view of the clear guidelines of UGC, DEC, the degree conferred by these deemed universities should not be entertained by the Government and stringent action taken against such deemed universities for duping and playing with the career of poor student of the state.
