Speaker rejects bill seeking abrogation of Section 3 of JK Constitution | | | EARLY TIMES REPORT SRINAGAR, Sep 15:In a significant development, the Private Member’s Bill submitted by Peoples Democratic Party (PDP) legislator seeking amendment of section 3 and 5 of Jammu and Kashmir Constitution, has been rejected by Speaker Legislative Assembly Mohammad Akbar Lone. The bill moved by Nizam-ud-din Bhat sought amendment of Section 147 that includes Section 3 and 5 which integrate Jammu and Kashmir into the Union of India. Bhat said: “The bill was sent back to me after the Speaker noted that it could not be admitted as Jammu and Kashmir Constitution doesn’t allow amendment of the Section 147.” Elaborating on the subject, the legislator from north Kashmir’s Bandipore said. “The current legislation neither allows amendment nor removal of section 147 or any of its sections. So the bill has not been accepted by the Speaker.” Terming the bill “imperative”, Bhat added, “The mainstream politicians, separatists and interlocutors have so far failed to give any viable solution to Kashmir issue, so the motive behind the bill was to seek empowerment of J & K Constitution which is imperative to solve the Kashmir tangle.” With the Delhi-based media raking up the debate over the bill, Bhat’s party disassociated from the bill saying that it was his individual decision. Reacting to his party’s stand, which had dissociated itself from his move, Bhat said, “The party (PDP) had to take a stand which they eventually did. I have no regrets, whatsoever, about my decision.”
