ACF sentenced to 3 yrs RI, fined Rs 10 lakh

JAMMU, Sept 16: Special judge anti-corruption Pawan Dev Kotwal today awarded three
years rigorous imprisonment to ACF Vijay Kumar Gupta under section 5(2) of
prevention of corruption act.
The court also imposed a fine of Rs 10 lakh on Vijay, who was project officer, Basantar

Project, and ordered that the fine amount be recovered from his estate and deposited

in government treasury.
The convict, who was present in the court, was taken into custody and sent to the

district jail here.
The judge observed that keeping in view all the relevant factors and nature of offences

and circumstances in which it was committed, corruption in public offices in country had

given birth to many other evils detrimental even to the integrity of the country and

stability of the system adopted by our forefathers. Therefore, this menace needed to

be curved at any cost and dealing corrupt public servants with iron hand was one such

measure.
As regards the disproportionate assets, the court said the accused not only failed to

account for these assets but also could not suggest the source of the same and

therefore, the only possible conclusion was that these assets were raised by him by

indulging in corrupt and illegal means.
The prosecution had, therefore, succeeded in establishing charges under section 5(1)

(e) read with 5(2) of the Prevention of Corruption Act and as such the accused was

held guilty.
The court said since the accused was 69 yrs of age and had been facing trial for the

last 12 years, harsh sentence would not serve the end of justice and rather recovery

of at least some amount of ill-gotten wealth amassed by him by corrupt means was

not only in the interest of justice but would also serve as deterrent for others.
With these observations, the court awarded three years rigorous imprisonment to the

accused and also imposed a fine of Rs 10 lakh on him.
