HC suspends sentence and grants bail to Store Khalsi

Jammu, September-21:- In a criminal appeal and CMP filed by Ashok Kumar Sharma who was sentenced by special judge Anticorruption Jammu to undergo three years’ rigorous imprisonment and fine of Rs 3 lacs in Disproportionate Assets Case, Justice J.P. Singh of J&K High Court today suspended the sentence and the fine imposed by special judge Anticorruption Jammu vide his order September 10, 2011 and ordered that applicant be released from custody in case he furnishes personal bond and surety to the tune of Rs 20,000 each to the satisfaction of special judge Anticorruption Jammu.
The prosecution had based its case on the complaint wherein the SVO conducted secret enquiry against accused Ashok Kumar Sharma the then Store Khalassi PHE Ground Water Division Jammu and found that the accused by corrupt and illegal means had amassed a palatial house at Shanti Vihar Patta Paloura besides others items and bank accounts disproportionate to his known source of income and he also owned one bus and a scooter and thereby the SVO had registered a case and started investigations. After completion of the investigations, challan was presented in the Court of special judge Anticorruption Jammu and on September 10, 2011 special judge Anticorruption convicted and awarded sentence to the accused.
Against the order of special judge Anticorruption Jammu, the convict filed criminal appeal with CMP in which Advocate G.S. Thakur appeared for the appellant whereas Gagan Basotra additional advocate general appeared for the state. Justice J.P. Singh after hearing both the sides observed that in view of the challenge made by the appellant to his conviction and sentence and the fact that the appellant’s appeal may not be heard at an early date, a case for suspension of appellant’s sentence pending hearing has been made out and suspended the sentence and the fine imposed by the Trial Court with the order to release the petitioner from custody.
