Baramullah administration misleads CM, yet to retrieve grabbed land
Complicating return of Kashmiri Pandits! Revenue deptt patronising illegal occupants

JAMMU, Sept 23: Despite tall claims of Chief Minister Grievance cell, a Kashmiri Pandit is yet to get his ancestral land in a remote Kashmir village retrieved from those who have grabbed it illegally.
On September 06, 2011, in a so-called high level meeting, Chief Minister's advisor Mubarak Gul was informed that grievance cell has disposed off 12,078 complaints as against total 12,992 complaints received ever since the Omar Abdullah launched the cell with much hope and hoopla two years back. He was informed that complaints are being disposed off "promptly" and officers 'on ground' responding satisfactorily".
Around the same time, a Kashmiri pandit Shambhu Nath, was pursuing Tehsildar, Pattan, to implement an eviction order passed by Deputy Commissioner (DC), Baramullah, more than a month back on August 12, 2011. To verify, one can check complaint number 24222 on the grievance cell website.
Complaint definitely has been disposed off very promptly - at least for the one to see on the site, but what the political advisor Mubarak Gul cannot probably check on the site is the level of "satisfactory response on the ground level". Shambhu Nath is fighting to regain control over his ancestral land (Late Pandit Ram Chand, owner; survived by Bishember Nath - now nomore, Prithvi Nath, Shambhu Nath and Chooni, current survivors) that has been illegally occupied by three encroachers as named in the complaint.
After sustained investigation into the matter, the encroachment has been proved to be illegal since Shambhu Nath has evidence from 1961 till date exhibiting self-cultivation of the property - all evidence has been filed in the office of Tehsildar, Pattan, and communicated to DC, Baramullah through Tehsildar's report. The report remarks "Records Girdawari 1971 till date do not reflect the tenancy of the possessors (Ghulam Rasool Sheikh, Ghulam Hassan and Abdul Rehman) and can be deemed as unauthorised occupant(s)". Following this observation, the DC, Baramullah directed Tehsildar, Pattan to "initiate necessary action" "under rules urgently". The case was marked as "Disposed" by the Grievance Cell on the August 12, 2011 at 16:01. The KP family had a reason to rejoice as the DC, Baramullah honoured Jammu and Kashmir Migrant Immovable Property Preservation, Protection and Restraint on Distress Sales Act, 1997, on unauthorized occupation.
The fact remains that even after being marked as "disposed", Shambhu Nath's trauma is still far from over. The case would be implied as "disposed" only if the eviction order passed by DC, Baramulla, is brought into force with as much quickness as the complaint was updated by Grievance Cell on the site that, now, appears as a jaundiced effort at providing succor to masses. But, as mentioned above, that is actually not the case; and over the last more than a month, the distressed Kashmiri Pandit family has realized that rather than reprimanding illegal occupants, administration is actually trying to benefit them. At one point of time, the family of Shambhu Nath claims that they were even hinted that they might need to pay the illegal occupants for the apple trees that they have planted in the land post-migration in order to get them evicted.
Around one month after the DC, Baramulla's order, Shambhu Nath's family was told that eviction would take place on September 08, 2011. Nath was present at Tehsil, Pattan. The illegal occupants had ganged up too; this time empowered by a human interface, Sarpanch, Kongamdara, more than the bunch of lies illegal occupants had been circulating from office to office. Backed by Tehsil staff, the Sarpanch intervened and proposed that the complainant must show restraint and the illegal occupants their logical mind (if any) and enter a mutually understanding ikrarnama to put an end to illegal occupants' misery. All this, as Shambhu Nath revealed, was uneasy (ikrarname even while eviction order should have been brought into force?). Shambhu Nath gheraoed, by everyone at the Tehsil did think it wise to honour Sarpanch and signed ikrarnama, which was supposed to become null and void in contents and commitments if illegal occupants defaulted on its due date - September 15, 2011. The illegal occupants did default coming up with all sorts of ridiculous pretexts. Sarpanch, who had owned responsibility on illegal occupants' part, is nowhere to be seen around since then.
Family of Shambhu Nath is unable to understand the compulsions under which the administration at Tehsil, Pattan has been delaying further action and thus providing leeway to illegal occupants and creating distrust in the complainant about the whole system at a time when Chief Minister Omar Abdullah claims that his government is creating good atmosphere where Pandits can feel secure for return. In the meantime, Shambhu Nath has pleaded with Mubarak Gul, to receive a status report on complaints within 15 days.
