Court rejects bail of doctor in dowry case | | | EARLY TIMES REPORT Jammu, September-24:- 3rd Additional Sessions Judge Jammu Sanjay Parihar today rejected the bail application of Dr. Javed Iqbal B-Grade Surgeon of Medical Dept, husband of Smaira Choudhary alias Gurpreet Kour who was allegedly involved in cruelty and dowry demand case. According to the case while Javed Iqbal was doing his MS Surgery at PGI Chandigarh, he met Gurpreet Kour and they fell in love with each other. In that period the accused Dr. Javed Iqbal assured the complainant for marriage. On completion of his course he left Chandigarh and did not contact the complainant. Then complainant got the telephone number of Dr. Javed Iqbal and came to Jammu, from where she when to Rajouri and met the relatives and family members of the accused where they decided to conduct their marriage, but it did not happen as per the statement of complainant The complainant then filed a complaint before the SSP Rajouri and case u/s 376 was registered against the accused Dr. Javed Iqbal. Upon this family members of Javed Iqbal asked the complainant to convert to Islam, she agreed and thereafter she married Dr. Javed Iqbal but after marriage husband and other relatives demanded dowry. She arranged more than Rs 50 lacs but even after that her husband and his relatives taunted her and her husband also beat her. Upon this, she filed a complaint in the Court of CJM Jammu u/s 498-A RPC. CJM sent this complaint to women cell. In her complaint she stated that besides committing physical torture, mental & sexual tortures, the accused has misappropriate property of Rs 50 lacs for which she has filed a separate complaint before the Court. Police registered a case u/ 498-A/420/409/406/120-B RPC. While rejecting the bail application 3rd Additional Sessions Judge Jammu after hearing advocate JP Gandhi appearing for the petitioner whereas additional public prosecutor, GS Charak appeared for the State and advocate AK Sawheny with advocate Aseem Sawheny for the complainant. The Court observed, “This court cannot skip away the matter under carpet when the complainant is whole heartedly contesting her case against Dr. Javed Iqbal. Had her case been store of lies, she could have gone back home and stayed with her parents and not pursued her remedy with such zeal. Already application of Dr. Javed Iqbal has been dismissed and therefore, no change in the circumstances rather, his police remand has been extended up to September 26, 2011 by the Court. Having regard to gravity of accusations and stage of investigation, this court declines to exercise discretion of grant of bail in favour of the petitioner Dr. Javed Iqbal at this stage and dismisses the bail application.”
