HC suspends sentence of AFC | | | EARLY TIMES REPORT Jammu, September-27 (JNF):- In an appeal filed by Vijay Kumar Gupta former ACF who was convicted and sentenced by Special Judge Anticorruption Jammu on September 16, 2011 under the prevention act to undergo RI for three years and further sentence to fine Rs 10 lacs, Justice Virender Singh of Jammu & Kashmir High Court Jammu Wing has suspended the sentence subject to depositing Rs 3 lacs out of the 10 lacs fine imposed and granted bail with the direction that he shall furnish personal bond to the tune of Rs 5 lacs with one surety of the like amount to the satisfaction of Registrar Judicial of High Court where an amount of Rs 3 lacs out of sentence Rs 10 lacs shall also be deposited. Counsel for the appellant submitted that the applicant was on bail during trial and never misuse the concession of the bail. The Trial Continued for about 12 years. He retired from service in the year 1999 and at present is of the age of more than 70 years. Court after hearing both the sides observed that keeping in view of the totality of facts and circumstances of the case and without commenting upon the merit or any other infirmity pointed out by the counsel for the appellant in the impugned judgment list it may least prejudice the case of either side at the relevant stage, when the main appeal is heard finally, the applicant who was on bail throughout the Trial and is now languishing in jail since the date he was convicted, deserves the concession of suspension of sentence during the pendency of appeal subject to his depositing Rs 3 lacs out of 10 lacs fine imposed and granted bail.
