Stolen vehicles recovered from under trial SI

JAMMU, Sep 27:-The Jammu and Kashmir police’s suspended Sub Inspector who was found guilty of managing job on fake documents was arrested by police with luxurious stolen vehicles from his possession.
The accused Sub Inspector Deepak Kapoor was to under go imprisonment for a period of three years and fine to the tune of Rs 3000 in one case while in an another offence under Section 420 RPC he was sentenced to undergo imprisonment for two years and fine of Rs 2000.
Kapoor who was undergoing trial was re-arrested by Narwal police led by ICPP Hilal Azhar from Narwal area with stolen Scorpio vehicle bearing registration number JK02X-5297.
The Sub Inspector during interrogation disclosed the hideout where he had kept the other stolen vehicles. On his disclosure, police recovered stolen vehicles including a Scorpio, Alto, Magic Auto and some chasis of vehicles.
His further interrogation was in progress and more recoveries and arrests are likely to be made.In this connection another case under section 420, 465, 468, 471 and 411 RPC stood registered against him.
Pertinent to mention here that third Additional Sessions Judge Jammu, Sanjay Parihar on Sep 15 awarded five years imprisonment and fine of Rs 5000 to Deepak Kapoor Sub Inspector , a resident of R S Pura, who obtained appointment as Sub-Inspector in the Police Department on forged documents.
According to the prosecution case, Crime Branch Jammu received a letter and enquiry file from Headquarters of Crime and Railways for registration of case. In the DO letter Dr SP Vaid, then DIG Jammu-Kathua Range wrote to then DGP that information from reliable sources was received in his office that Deepak Kapoor (accused) has produced fictitious BSc pass provisional certificate with marks list purported to have been issued by the Magadh University, on the basis of which he has secured job in the Police Department as Sub-Inspector.
On this, a case FIR No.21/2001 under Sections 420, 467, 468 and 471 RPC was registered in the Police Station Crime Branch Jammu. During the course of investigation, record including personal file of the accused containing Xerox copy of BSc provisional certificate and marks list purportedly issued by Controller of Exams, Magadh University was seized.
When the Controller of Exams, Magadh University was approached, it came to fore that accused has not passed BSc from there. The investigation by the Crime Branch was concluded with the findings that the accused fraudulently, intentionally and dishonestly managed fake degree certificate of BSc Part-III and used the same in cheating Police Department.
In this way, the accused obtained undue gains and caused loss to the State Exchequer by getting appointment as Sub-Inspector in the Police Department. He received an amount of Rs 34066 as monthly salary from Police Academy Udhampur and an amount of Rs 4498 was still outstanding against him on account of mess charges.
It also came to fore that accused was a habitual offender and was involved in cases registered at Gandhi Nagar Police Station under FIR No 65/2002 under Section 392, 342, 201 RPC and FIR No.495/ 2000 under Section 420, 411, 467, 468 and 471 RPC.
After hearing APP G S Charak appearing for the State whereas Advocate Ved Raj Wazir appearing for the accused, 3rd Additional Sessions Judge Jammu observed, "as the accused has undergone trial for a period of eight years, for offence 471 RPC accused Deepak Kapoor is sentenced to under go imprisonment for a period of three years and fine to the tune of Rs 3000. For offence under Section 420 RPC he is sentenced to undergo imprisonment for two years and fine of Rs 2000".The Court, however, clarified that both the sentences will run concurrently. However, the alleged accused filed another plea in High Court to get the fresh proceedings initiated.
