HC quashes PSA of alleged hardcore criminal and bovine smuggler | | | EARLY TIMES REPORT Jammu, September-29 (JNF):- Justice JP Singh of J&K High Court Thursday allowed two habeas corpus petitions challenging the detention under Public Safety Act and quashed the detention order passed by the District Magistrates under Public Safety Act. In a habeas corpus petition filed by Amarjeet Singh against whom 16 FIRs have been registered in different criminal cases including the Excise Act had challenged the detention order passed by the District Magistrate Jammu. Justice JP Singh after hearing advocate DS Saini for the petitioner/detenue and AAG Gagan Basotra for the State, quashed the detention order of Amarjeet Singh alias Kaka and directed the respondents to set him to liberty forthwith unless he was required in any other case. Another habeas corpus petition was filed by Maqbool Hussain who challenged the detention under Public Safety Act on various grounds that the material relied upon the by the District Magistrate Samba that is the police dossiers of SSP Samba and copy of FIR 110/2011 registered at P/S Samba u/s 188 RPC and 3/6 Prevention of Cruelty to Animal Act 1990 as the detenue was allegedly involved in Bovine Smuggling. Justice JP Singh after hearing advocate Amit Gupta for the detenue and AAG Gagan Basotra for the state observed that detention order passed by the District Magistrate Samba on the similar grounds based on the same FIR have already been quashed by this Court allowing detenues Habeas Corpus No 38 and 39 of 2011. Justice JP Singh allowed the habeas corpus petition quashing the order of District Magistrate Samba passed on May 23, 2011 and directed the respondents to set Maqbool Hussain detenue to liberty forthwith unless he was required in any other case.
