| HC directs applicant to surrender before Trial Court | | | Jammu, Dec 6 Justice Nirmal Singh of J&K High Court Jammu wing in a criminal petition seeking quashment of Trial Court order, has directed the applicant to surrender before the Trial Court on Dec 18 and in case any bail application is moved by the applicant the same shall be disposed off within four days. In case the applicant does not appear before the Trial Court on December 18, 2006, be kept in custody till the trial is over, the Court ordered. . According to the case on November 7, 2001, the complainant Mrs. Suman Kumari wife of Tarsem Lal r/o Badheri Tehsil Samba appeared in the police station in an injured condition along with her brother-in-law and orally reported that on dispute of user of passage the accused persons namely Bansi Lal, Satpal and Yash pal Sons of Santokh Ram r/o Badheri Tehsil Samba attacked on her and injured her while accused Yash Pal and other accused beat her with bricks and kicks. Upon this a case u/s 324/34 RPC was registered and after completion of the investigation on February 26, 2002, a challan was presented in the absence of accused Yash Pal and police prayed for initiating proceedings u/s 512 CrPC. After appeals Sub-Judge Samba Ms Bala Joyti on September 14, 2006 declared Yash Pal as absconder and proceeded u/s 512 CrPC, which was challenged in the High Court and the High Court issued above said directions.
