Court awards life imprisonment and fine to two accused in murder case after 18 years

Jammu, October-01 (JNF):- Principal Sessions Judge Jammu, Jang Bhadur Singh Jamwal today awarded rigorous life imprisonment to accused Jeet Kumar and Suresh Kumar u/s 302/149 RPC and a fine of Rs 10,000 each after 18 years investigation and trial. The court also ordered that the fine imposed upon both the accused be realized and out of the fine each of the surviving injured shall be reimbursed with Rs.1000/ as compensation.
According to the police case, on May 31, 1993 one Jatinder Kumar in an injured state accompanied by other injured persons namely Guldev Singh, Raj Kumar and Mst.Sandya Devi lodged a verbal report alleging therein that accused Karnail Singh without any right had been interfering in his land possessed by him and had inimical relation with them. It was further alleged by him before the police that on the same day at about 5.00 am. he in the company of his father Guldev Singh was going to his field and when they were on their way, the accused persons armed with deadly weapons blocked their way and attacked upon him and his father and inflicted injuries with swords as a result of the injuries his father’s wrist was cut. He raised hue and cry and on hearing the cries Raj Kumar and Sandya Devi came on spot but they were also attacked and injured by the accused persons. Incharge police station Arnia on the said verbal report registered a case U/s 307, 148,149 and 341 RPC at 7.30 in the morning. The police referred the injured to the SMGS Hospital Jammu and commenced the investigation. One of the injured namely Raj Kumar succumbed to the injuries on the same day in the evening and added section 302 RPC.
The accused Jeet Raj and Suresh Kumar were absconding and were proceeded against under sec.512 Cr.P.C. and declared proclaimed offender. The trial against the other accused Tilak Raj and others was conducted before Additional Sessions Judge, Jammu who vide its judgment dated March 19, 1996 convicted all the accused. Tilak Raj, Karnail Singh, Darshan Lal and Krishan Lal were convicted under sec.302/149 RPC, 4/25 Arms Act and sentenced to undergo imprisonment for life and fine vide order dated March 26, 1996 passed by Addl. Sessions Judge, Jammu. The accused Jeet Raj and Suresh Kumar surrendered at later stage and charge has been descended upon them, however the bail of Suresh Kumar was rejected by this Court.
Principal Sessions Judge Jammu Jang Bhadur Singh Jamwal after referring various judgments of the Supreme Court and High Courts observed that Court is satisfied that the sentence shall serve the purpose and awarded rigorous life-imprisonment to accused Jeet Ram and Suresh Kumar u/s 302/149 RPC and fine Rs 10,000 each.
