Court awards 3 years RI and fine to accused causing grievous injury | | | EARLY TIMES REPORT Jammu, October-05 :- Principal Sessions Judge Samba RS Jain awarded there years rigorous imprisonment and a fine Rs 2000 to accused Shiv Durga Dayal s/o Ram Murti r/o Ward No 3 Vijaypur who was facing trial for last five years. According to the police case on June 21, 2006 the police recorded the statement of injured Shakti Kumar in GMC hospital, Jammu which was to the effect that the complainant Shakti Kumar is a resident of Ward No.3, Vijaypur and is running a shop at Gura Morh. That accused Ram Murti is his real uncle and there is a dispute between them over land. That on June 20, 2006 at about 4.45/5 P.M., complainant was sitting outside his shop when accused Ram Murti and Shiv Durga Dass having an intention to murder the complainant came on spot and that Shiv Durga Dass attacked the complainant with an sharp edged weapon on the head and police registered a case for offence u/s 307/34 RPC/4/25 Arms Act and after completion of the investigation challan was presented in the Court. Principal Sessions Judge Samba RS Jain after hearing both the sides observed that in view of the evidence adduced by the prosecution, it stands proved that accused Shiv Durga Dayal armed with a sharp edged object attacked and caused grievous injury and simple injury on Shakti Kumar and is convicted for offence u/s 326/323 RPC and awarded there years rigorous imprisonment and fine Rs 2000. At this stage Court acquitted Ram Murti.
