Court rejects pre-arrest bail of bank employee

Jammu, October-07 (JNF):- Special Judge Anticorruption Jammu Pawan Dev Kotwal today rejected the pre-arrest bail application of one Manzoor Ahmed s/o Saif-ud-Din an employee of J&K Bank Kishtwar against whom a case along with accused for fraudulent withdrawal of Rs 4, 60, 000 by forging cheques.
According to the prosecution case that applicant being employee of J&K Bank Kishtwar illegally gave the three account numbers of customers having sufficient amounts in the said accounts by conniving with the other accused and facilitated him to withdrawn an amount of Rs 4, 60, 000 from those accounts by forging cheques in the cheque book of one Satya Devi who had lost the same, a case u/s 409/420/467/468/471/120-B RPC and 5(2) PC Acts 2006.
Court Called report from concerned police and CPO was directed to file objections. While dismissing the pre-arrest bail application, the court observed that after hearing both the sides and perused the record on file. From the report it is revealed that applicant has been arrayed accused in the said FIR. The bail application has been opposed by the prosecution on the grounds that applicant is not cooperating with the Investigating Agency and he has connived with other accused namely Zahoor Ahmed for fraudulent withdrawal of amount from the bank, the prosecution seeking his custodial interrogation. Court further said that a huge amount has been withdrawn from the accounts of innocent depositors fraudulently and therefore, the plea of prosecution that the applicant needs to be interrogated to establish involvement of other employee persons is not unreasonable. The applicant is employee of the said bank and grant of bail at this stage when the investigation is still at infancy stage will encourage him to influence the witnesses and temper with the record. With these observations Court dismissed the bail application filed by the applicant for grant of pre-arrest bail. JNF
