Tehsildar ,Patwari in Vigilance net

SRINAGAR, OCTOBER 07:-The State Vigilance Organization has registered a case against Riaz Ahmed then, Patwari Halqa Hakkal Tehsil and District Jammu, Sh. Narayan singh then Tehsildar Settlement,Jammu and private persons namely Ravinder Singh, Romesh Chander and Rajesh Gopal sons of late Sh.Shiv Dhan Singh R/o Village Hakkal, Tehsil and district Jammu for fraudulent manipulation and tampering of revenue record.
Verification conducted by Vigilance Organization into the allegations pertaining to fraudulent manipulation / tampering and destruction of revenue record of Khasra no.12 of Village Hakkal, Tehsil and District Jammu by Riaz Ahmed ,Patwari Halqa Hakkal has revealed that during the year 2007 then patwari Halqa-Hakkal Sh. Riaz Ahmed, in connivance with the beneficiaries namely Ravinder Singh, Romesh Chander and Rajesh Gopal sons of late Sh. Shiv Dhan Singh R/o Village Hakkal, Tehsil and district Jammu, prepared fraudulent fard intikhab which were illegally attested by Sh. Narayan Singh then Tehsildar Settlement Jammu w.r.t land measuring 22 kanals 19 marlas under Khasra no.12 situated at Village Hakkal, showing the possession and ownership of the said land in the name of above said beneficiaries in order to facilitate the sale of said land to different persons. On the basis of said fraudulent fard intikhabs, the sale deeds were executed by the above mentioned beneficiaries in favour of different vendees by concealing the facts from the concerned court. The said sale deeds were there after mutated illegally on 16.07.2009 vide mutation no. 40 /Jim to 45 / Jim.
It has been found that vide mutation No. 504 u/s 4 of Agrarian Reforms Act 1976 dated 26.03.1981 the said land measuring 22 kanals 04 marlas was transferred to state and the ownership rights of Ex-owner Late. Sh. Shivdhan Singh were extinguished and could not have been restored back to the Ex- owner Shivdhan Singh or his sons as the same was under the cultivation of Late Sh. Mohinder Singh @ Harminder Singh, S/O Sh. Basantu, R/O Hakkal who was declared as prospective owner.
Copy of the mutation No. 911 u/s 8 of Agrarian Reforms Act dated 19.08.2004 issued by the said patwari reveals that Kehar Singh and Girdhari Singh sons of Late Sh. Mohinder Singh @ Harminder Singh are the owners but the said mutation No. 911 is not found in mutation register, Parth Patwar and
Parth Sarkar and has allegedly been destroyed by the said patwari in order to authenticate the fraudulent entries made by him.
It has been further revealed that in the year 2009 Kharief the said patwari despite the knowledge that the beneficiaries / heirs of Ex-owner Late Sh. Shivdhan Singh are not holding possession of the said land and instead the said land is still under the possession of sons of late Sh. Mohinder Singh, deleted the Girdwari entries of Late Sh. Mohinder Singh / his sons in revenue record and entered the Girdwaries as well as Virasat Intkal in the revenue record in the name of beneficiaries and other heirs of Ex-owner late Sh. Shivdhan Singh.It is pertinent to mention here that prior to year 2009,the beneficiaries had already executed sale deeds w.r.t. above said land in the year 2007 on the basis of fraudulent fard intkabs prepared by the said patwari and attested by then Tehsildar Settlement, Jammu.
In this manner the above said patwari and then Tehsildar Settlement, Jammu by abuse of their official position and in furtherance of conspiracy hatched with the beneficiaries Ravinder Singh, Romesh Chander and Rajesh Gopal sons of late Sh. Shivdhan Singh and others fraudulently / dishonestly prepared and issued the revenue record in order to cause wrongful gain to the beneficiaries and others and hence the Vigilance Organization registered a Case FIR No. 23/2011 P/S VOJ u/s 5 (1) (d) r/w 5 (2) J&K P.C Act 2006 and sections 167, 467,468, 471, 420 and 120-B RPC against them.
