10/8/2011 9:26:45 PM
EARLY TIMES REPORT
Jammu, October-08:- 2nd Additional Sessions Judge Jammu Subash C Gupta today rejected the bail application filed by Jatinder Singh s/o Choudhary Nagar Singh who is facing trial in the much publicized Amandeep Murder case.
The bail application seeking temporary bail was filed by Jatinder Singh for attending the marriage ceremony of his sister-in-law with effect from October 9, 2011 to October 14, 2011.
After hearing advocate RK Kotwal appearing for the accused-petitioner whereas Special Public Prosecutor Sr. Adv Sunil Sethi appeared for the State, 2nd Additional Sessions Judge Jammu Subash C Gupta observed that in the application it has been mentioned that marriage of sister-in-law is not possible as per traditions and customs, in absence of the accused-petitioner. It is however, not mentioned the detail of customs and rituals which are required to be performed by a brother-in-law in the performance of the marriage of his sister-in-law and admittedly petitioner’s sister-in-law are to be governed by Hindu Law and marriage is to be performed according to the Hindu Customs and Rituals. So far as knowledge of the this Court, no ceremony or customs is required to be performed by a brother-in-law in the marriage of sister-in-law. Parents of a female hindu who is going to marry has to be preformed certain ceremonies and customs for performing her marriage as per Hindu Rights and customs prevailing among hindus and more particularly in the locality of Jammu. It is further no clear as to whether the accused-petitioner has got the invitation of the marriage as the card enclosed with the application is silent in this regard. It appears that the accused want to enjoy pump and show of the marriage by availing temporary bail which cannot be possible as he is to be kept outside the main stream of the society and rejected the bail application.
