Court denies pre-arrest bail to rape accused

Jammu, October-10:- Forest Magistrate Jammu Adnan Sayeed denied pre-arrest bail to Dr. Shehzad Ahmed Qureshi who allegedly tried to rape his minor step-daughter.
According to the police case the accused Dr/ Shehzad Ahmed Qureshi contracted marriage with his cousin who was divorced by her earlier husband and had one daughter of 7/8 years and one son of 5 years. The accused wanted to have an issue out of the wedlock which was disliked by his wife who is already mother of two children and this demand of the accuse was not honoured by her which gave both soaring relations gradually. The wife of the accused Nelofar filed a complaint with the Court of CJM Jammu on September 23, 2011 which remained pending for a couple of days and ultimately was referred to P/S Bakshi Nagar for registing the FIR. Police case reveals that on September 26, 2011 complainant came along with the application duly marked by CJM Jammu, upon which FIR NO 140/2011 u/s 376/511 RPC was registered and in the application it was alleged that on September 23, 2011 at about 4:00 PM when the applicant came back from her driving institute saw her husband (accused) forcibly trying to rape her 10 years old daughter, she managed to save her daughter from the clutches of the accused. Her daughter was so terrified that she did not speak a single word and she went to the concerned police station for taking action but all in vain. Thereafter she approached the Court for directing the Incharge P/S for lodging FIR.
Forest Magistrate Jammu Adnan Sayeed after hearing senior prosecuting officer Sanjay Kohli appearing for the State and counsel for the accused observed that prosecution filed objections opposing grant of bail to the accused on the ground that investigation in this case is still in progress and the accused is absconding and avoiding arrest and said that the accused tried to commit rape on the minor daughter. The offence is heinous in nature. Court after perusing the CD File and observed that the investigation is in the initial stage and the accused is absconding and not arrested yet nor has surrendered before the Court. With these observations Court denied bail to the petitioner.
