Opposition gets united on CBI probe demand: PP files PIL in SC
Judicial probe or CBI inquiry...... a long drawn affair?

JAMMU, Oct 10: J&K National Panthers Party which is already up in arms against the government and has intesnified its protests over fair probe into Syed Yousuf's death in custody and other related aspects of the episode, today formally made a legal move in this direction with filing of PIL in Apex Court through its supremo Prof Bhim Singh, seeking inquiry by CBI into the matter. The opposition parties in the state are getting united in echoeing this demand unequivocally at a time when the government is still exploring the possibility of judicial probe , the Chief Minister already having spoken to concerned quarters in Delhi . The moot question remains that in both the cases, CBI inquiry or judicial probe, will it be time bound or a long drawn affair….?
In the writ petition filed in the Supreme Court of India Panthers Party has sought direction to the Union of India and the J&K government to hand over the case of alleged murder of Syed Yusuf Haji to the CBI. While the petition has listed the sequence of events in a detailed manner, its focus remains on highlighting the failure of the government in filing an FIR in the matter under proper section and for the purpose of his death in custody. Apart from other relevant details Bhim Singh has question and observed that there was no information given to the family members of Yusuf Haji. Nor any F.I.R. was filed on the death of Yusuf Haji, according to the police version was taken to the headquarters of Crime Branch in the night. Interestingly, instead of registering an F.I.R. relating to death of Yusuf Haji, an F.I.R. No. 17/2011 u/s. 420 RPC was registered, he further observes in the PIL adding that no F.I.R. u/s. 174 Cr.P.C. has been registered in spite of the public wrath in J&K and all over the country.
Prof Bhim Singh has contended in the Petition that government is adamant to hush up the case as the Chief Minister and a Union Home Minister have been named as recipient of bribe money. The justice can only be done if inquiry is made by an independent agency which is not subject to the direction or command of the echelons of power in the administration or in the police in J&K, he has stated in the petition , asserting and explaining the need for filing this petition in response to public demand that CBI inquiry should be held into the events and circumstances that led to the death of 61-year-old political activist.
On the political front, while this move brings on one platform all the opposition parties in seeking CBI probe into the matter, it remains to be seen when and whether it gets admitted in the Supreme Court. Interestingly, the state government has also sought the probe by a sitting judge , and the response is being awaited as the same is to be understood to have direction from the Apex Court first. In other words , it is the Apex court direction which will determine and decide as to what kind of inquiry will be finally ordered into the matter.
