Kishtwar girl bails out rape accused v`His wife forced me to file case'

kishtwar, Oct 11: A teenage girl Babli Devi (Name changed) was forced by the wife of accused police inspector Vijay Kumar Bhaghat to register a rape case against his husband over minor family dispute.
According to girl's statement in case FIR No: 276 U/S 376 RPC before the Chief Judicial Magistrate Kishtwar under section 164 CrPC, Seema Khathora daughter of a retire SSP and wife of accused police Inspector Vijay Kumar Bhaghat presently in police custody forced her to registered false case of rape against accused police inspector.
The girl stated that her father worked as a mason at the residence of accused Vijay Kumar Bhaghat and one day she went at his residence to see her father, where she was sighted by Seema Khathora who insisted her husband Vijay Kumar Bhaghat to keep her as baby sister in the house.
The girl's father granted permission and she came to in Seema's house. She further stated that Seema Khathora took her to Jammu, where she (Seema Khathora) brutally beat her and on this she called her father about the incident. She said her father called Vijay Kumar Bhaghat and narrated the whole story to him. She said that her father asked Vijay Kumar Bhaghat to send his daughter back to home.
After returning from Jammu on 2-10-2011, Vijay Kumar Bhaghat and his wife exchange heated arguments, she said. "Next day when Seema Khathora left for Padder to attend the duty, Vijay Kumar Bhaghat dropped her at his parents' residence. On 4-10-2011 Seema Khathora reached her house and forcefully took her along to his residence. Vijay got angry on seeing her at his residence. Later Seema Khathora took her to police station and asked her to state that Vijay Kumar Bhaghat had forcefully raped her and also threatened her in case she refused to register the case."
She stated that Seema often fought with his husband over minor matters. She said in absence of Vijay Kumar Bhaghat, one person (Whose name hasn't been mentioned) use to visit the house to spend quite some time with Seema.
Meanwhile CJM Kishtwar has deferred the bail plea of the accused till tomorrow. Defense counsel stated that if the victim in her statement stated that his client have never committed rape on her than his client has a right to get bail.
