Court denies pre-arrest bail to Patwari

Jammu, October-12:- Special Judge Anticorruption Jammu Pawan Dev Kotwal rejected the pre-arrest bail application of Riaz Ahmed Patwari who is involved in more than 22 Kanals Land Scam.
According to the objections filed by the CPO Parshtom Sharma for the VOJ submitted that the allegations against accused-applicant are that land measuring 22 Kanal 19 Marlas comprising KH 12 of Village Hakkal was mutated u/s 8 of Agrarian Reforms Act in favour of Kehar Singh and Girdhari Singh, sons of prospective owner Mohinder Singh vide mutation NO 911, but the applicant who was then Patwari in the said village in connivance of sons of ex-owner prepared fraudulent Fard-Inkhab which was allegedly by attested by the setteled by then Teshildar Settlement Naryan Singh and on the basis of said Fard-Inkhab, sale deeds were executed in favour of different vendees and even mutation came to be attested on the basis of such sale deeds on July 16, 2009.
CPO Parshtom Sharma opposed the bail application on the grounds that investigation of the case is at initial stage and accused-applicant is required for custodial interrogation to unearth between him and other public servants and beneficiaries.
Special Judge Anticorruption Jammu Pawan Dev Kotwal after hearing CPO Parshtom Sharma appearing for the VOJ observed that applicant-accused has been booked by the Vigilance organization for the offences u/s 5 (a) (1) (d) r/w 5(2) J&K PC Act 2006 and 167/467/468/471/420 & 120-B RPC. The application as per his own admission in the application was posted Patwari in the said village when the alleged fraudulent sale deeds came to be executed on the basis of fake/ forged record prepared by him. The rightful owners therefore, seems to have been deprived of his land because of the criminal Act of the accused committed obviously in abuse of his official position which not only caused loss to the actual owner, but such act by the public servant who are responsible to prepare genuine record and custodian of the same, also betray the trust deposed in him by the common people. With these observations dismissed the pre-arrest bail application of Patwari. JNF
