| Court rejects bail in blackmailing case | | | EARLY TIMES REPORT
Jammu, October-12:- The Third Additional Sessions Judge Jammu Sanjay Parihar dismissed the bail application of Sonal Gondhi of Jullakha Mohalla who was arrested by the police u/s 306 RPC for abetment to commit suicide by the deceased Amandeep Kour who was student of 11th class.
As per police case on August 20, 2011 the girl 11th class student committed suicide allegedly by the harassment of the accused. According to the police it was found that accused harassed the victim to develop physical relation with them and extended threats that accused is having her photographs which otherwise he will display the same on internet.
The court observed that no doubt accused-petitioner is stated to be student and in the prime of his youth, but that cannot be a ground for his admission to bail in such heinous offence having regard to the part played by him towards the commission of such offence. His counsel sought the refuge by arguing that offence u/s 306 RPC does not attract bar u/s 497 (1) CrPC which again is without basis, since it is not always punishment for the offence alleged to be considered at the time of the considering bail. In this back ground, Court is of the considered view that having regard to the nature of the accusations and impact of the such accusations on society at large and having regard as to the nature of act played by petitioner towards the commission of suicide by deceased, at this stage when the matter is still under investigation, petitioner Sonal Gondhi does not deserve to be admitted to bail and his bail petition as such is dismissed.
