Haveli rape case | HC directs SSP Poonch to appear in person | | EARLY TIMES REPORT Jammu, October-14 :- Justice JP Singh in a petition filed by Hanifa Bi and Other has directed SSP Poonch to appear to show cause as to why he be not proceeded against for avoiding execution of the warrants issued by the Court. The Court took serious note of non-compliance of warrants by the SSP and directed him to appear in person.
This direction has been issued in a petition criminal petition filed by Hanifa Bi w/o Mohd Shabir an employee of BSF r/o Mangnad Tehsil Haveli District Poonch and victim. In the petition it has been submitted that on August 18, 2010 at about 10:00 AM the victim as usual left her house for school, when reached half a way, A Tata Sumo came from behind stopped victim by one Shahnaz Akhter real sister of alleged kidnapper Maqsood Hussain got down from the vehicle and asked the victim to accompany her to Shahdara Sharief but the victim refused. On the repeated persuasion of said Shahnaz Akhter, the victim acceded to the said proposal. The victim got into the vehicle after about five minutes. The said vehicle was stooped by the driver and Shahnaz Akhter got down on the pretext of getting some eatable items towards the shop. Meanwhile the driver of the vehicle drove away the vehicle towards Rajouri, after going about 5/10 KMs, alleged kidnapper Maqsood Hussain s/o Lambardar Akbar Hussain and Maqasood s/o Mohd Sadiq who were hiding under tirpal near the rare seat of the vehicle and sat on the right and left sides of the victim and hold her tight and threatened her on the knife for killing her if she did not obey their dicdates. The alleged kidnappers brought the victim to Rajouri and from there to Jammu and kept in a hotel and on the next day to Delhi where she was kept under forced custody for about 7 days. The victim was repeatedly raped at Jammu as well as Delhi by the alleged persons in which Shahnaz Akhter sister of one of the alleged accused and Shahid Hussain driver of the vehicle had actively helped in commission of the Crime.
