| HC stays suspension of Patwar | | | EARLY TIMES REPORTi
Jammu, October-15 (JNF):- in a petition filed by Patwari Raj Kumar challenging his suspension order issued by the Deputy Commissioner, Justice Mansoor Ahmed of J&K High Court has issued notice to the respondents returnable within two weeks, Dasti Service is also permitted.
Justice Mansoor Ahmed Mir after hearing advocate SK Raina for the petitioner observed that it is contended that Deputy Commissioner has no power and competence to place the petitioner under suspension thus ordered May 31, 2011 came to be passed without jurisdiction. It appears that communication was made by the Assistant Commissioner (Central) of Divisional Commissioner Jammu to Deputy Commissioner Udhampur for submitting detail back-ground of the case.
Court after considering the arguments of advocate SK Raina appearing for the petitioners ordered that in the meanwhile subject to objections from the other side and till next date of hearing before the Bench, operation of order dated May 31, 2011 is stayed in so far as it relates to suspension of the petitioner. However, respondents are at liberty to conduct the enquiry, Court ordered.
