Court awards 20 yrs RI ,fine Rs 1 lac to two narco smugglers | | | EARLY TIMES REPORT Jammu, Oct 17 : 3rd Additional Sessions Judge Jammu Sanjay Parihar today awarded rigorous imprisonment for twenty years with fine of Rs 1 lac each to Rashpal Singh s/o Janak Singh r/o Battal Majalta and Kuldeep Sharma s/o Nathu Ram r/o Billawar Kathua from whom police recovered 3410 KG poppy straw. According to the police case that on March 30, 2010 Incharge Police Post Manwal received information from a reliable source that a Truck HR38-4448 was carrying poppy straw from Srinagar towards Jammu which was driven by Rashpal Singh and owner Kuldeep Sharma who are smugglers of contraband and in this regard. After the search of the truck poppy straw weighing 3410 KG was recovered and a case u/s 8/15 NDPS Act was registered and after completion of the investigation challan was presented in the court of law. Court acquitted Jeevan Khajuria as evidence led by prosecution towards his participation in such charge is found lacking as such the accused Jeevan Khajuria acquitted of the charge and shall be released forthwith, Court ordered. 3rd Additional Sessions Judge Jammu Sanjay Parihar after hearing Adv DK Khajuria for accused Rashpal Singh, Adv Ashwani Khajuria for accused, AdV HC Jalmeria for accused Jeevan Khajuria who was acquitted by the court whereas APP GS Charak appearing for the state, observed that the prosecution successfully has proved behind doubt that accused Rashpal Singh was the driver of the truck in which 3410 kg of poppy straw was loaded in 90 jute bags and had been kept concealed underneath pieces of leather with accused Kuldeep Sharma as the owner of the consignment were found in possession of the poppy straw which they carried in the truck unauthorizedly as their has been enormous increase in menace of drug trafficking that has led deterioration of the health of value of young generations. Thereby hitting the most valuable section of society at large, in this 3410 KG of poppy straw came to be recovered which quantity being enormous and if would have reached to the destination, one can assume the harm that it would have cause to the people at large. Court is of the considered view that both the accused does not deserve to be dealt leniently and they are convicted for offence u/s 8/15 NDPS Act and sentence to undergo rigorous imprisonment for twenty years each with fine Rs 1 lac each.
