HC issues direction regarding renewal of ultrasound center

Jammu, October-20:- Justice Virender Singh of J&K High Court has directed the Director Health Services Jammu to get the Pooja Ultra Sound Center inspected once again by duly constituted team within a weeks time to find out the deficiency if any will be apprised of the same at the spot in writing enabling him to make the deficiency good within 15 days. In the even their remains no deficiency the respondents would finalize the case of the petitioner’s ultra sound center for its registration under relevant rules within two weeks thereafter.
This direction has been issued in a petition filed by Pooja Ultra Sound Center and Ors. According to the petition registered under J&K Nursing Homes and Clinic Establishments (Registration & Licensing) 1963.
By the order official respondents October 1, 2009 whereby ultrasound clinic has been sealed on the pretext that the same is functioning without any registration is called the question vide interim order dated October 6, 2009 was stayed by the High Court.
Deputy AG S Hakim appearing for the Director Health Services stated that the Ultra Sound clinic was inspected by the Team constituted for the purpose of granting registration under PNDT Act and while inspection it was found that the clinic is not complying with certain requirements of rules. On the Other hand Sr. Adv DC Raina appearing for the petitioner submitting that in fact all the deficiencies have already been removed and in this regard an intimation dated September 30, 2011 has also been sent to Chief Medical Officer Rajouri making it further clear that if there is any deficiency still left, the same can also be removed at the earliest. Sr. Adv DC Raina further submitted that despite the fact that all the deficiencies already stood removed and the official respondents in al fairness should have considered the application of the petitioners for renewal of the license pending since long. Adv still has not objection if the clinic is once again is inspected by any of constituted officials of the health dept to find out whether there is any deficiency still left. Counsel for the petitioner assured that the pointed deficiency, if any, shall be removed at the earliest. Upon this Justice Virender Singh disposed of petition with the direction to Director Health Services Jammu to get the ultrasound center inspected once again.
