Court accepts closure report in corruption case

Jammu, November-01:- Additional Sessions Judge Anticorruption Jammu Jaffer Hussain Beigh has accepted the closure report filed by Crime Branch Jammu in FIR 12 of 2006 u/s 420/467/468/471 RPC r/ section 5(2) J&K PC Act.
The complainant Hari Chand lodged a written report on May 30, 2006 in which he has alleged that due to allotment he was in cultivating possession of the land of custodian dept measuring 32 Kanals comprising different Khasra situated at Village Palouta Tehsil Samba but accused Hans Raj s/o Labhu Ram and Tej Ram s/o Durga Dass r/o Ram Garh hatched a criminal conspiracy with revenue dept and managed to change the Khasra Girdawari in their names with the knowledge of the complainant. On this FIR was registered in P/S Crime Branch Jammu and investigating officer GL Sharma after conclusion of the investigation closed the case as not proved and closure report dated October 4, 2007 was produced in the Court where complainant party filed a protest petition and also approached the IGP Crime for transferring the investigation to some other IO as according to the complainant IO GL Sharma biased towards him. On the direction of the Court when the Court did not agreed with the investigation directed the case to be re-investigated by some other IO. On this the case entrusted to SI GC Manhas. With regard to the allegation of change of girdawari of the complainant, the IO conducted fresh investigation but the allegation leveled against the accused could not be substantiated and investigation of the case was again close as not proved and police submitted the closure report on before Court. Court after examining the closure report made the observation on August 18, 2009 and remanded the case back for reinvestigation by a competent officer of rank of DySP. Accordingly the case was entrusted to the then DySP Virender Singh Manhas and after his transfer the said case was entrusted to DySP HL Pandita. After fresh probe by the IO, the present closure report has been filed by the Crime Branch with averments that there is no evidence available against the alleged accused persons to substantiate the allegations leveled against them. As such case is closed as not proved.
The court after hearing the parties observed that it has been established that all the revenue officials and officers have done their duties as per Govt standing order by and circular issued there under and as per the directions of superior officers which investigating officer collected during the course of investigation. There is not an iota of evidence on record which suggests that alleged accused or any person in the present case has cheated or committed forgery or any offence of corruption or even any other offence and agreed with finding of Closure Report presented by the Crime as case not proved and accepted the same.
