PIL regarding unreasonable Fee for Right to Information Act DB Directs CS to file affidavit

Jammu, November-03:- In a Public Interest Litigation BR Manhas, a practicing lawyer has challenged the free prescribed by the State Govt in Rules 4, 5 & 6 of J&K Right to Information Rules 2010 maintaining that the fee prescribed is unreasonable, irrational and against the spirit of the Right of Information Act as it is much higher than the fee prescribed by the Central Govt and Other States of the country under Similar Rules. The PIL has sought quashment of the said Rules.
A Division Bench of Jammu & Kashmir High comprising Justice JP Singh and Justice Mohammad Yaqoob Mir after hearing the PIL filed by BR Manhas, issued notice to Chief Secretary to file affidavit within four weeks indicating State Govt’s response to justify prescription of fee as indicated under Rules 4, 5 & 6 of J&K Right to Information Rules 2010.[
