Two day workshop concludes | Civil Society discusses role of RTI in Police accountability | | Early Times Report JAMMU, Nov 3: To chalk out circumstances in which citizens require information from police and to develop citizen intervention and ensuring people friendly and democratic policing in J&K by using RTI, two day workshop concluded here today. The workshop was organised by Commonwealth Human Rights Initiative (CHRI) an international NGO based in Delhi in association with J&K RTI Movement. The theme of the workshop was Right to Information and the Police in J&K. Speaking at the programme Navaz Kotwal Project Coordinator of Police Reforms at CHRI threw light on the various laws under which J&K Police works. She said a strong civil society group is need of the hour to start with intervention on this issue in J&K. “The Government has shown some openness with regard to make new draft “Police Act “ public and the Government must now start taking Civil Society and other stake holders into confidence by holding consultations with them before the bill is tabled in legislature, Navaz added” Venkatesh Nayak, an RTI law expert from Commonwealth Human Rights Initiative (CHRI) urged upon the civil society to make use of RTI Act for making police more accountable & transparent.
He said that there are various draconian laws like Armed Forces Special Powers Act (AFSPA), Disturbed Areas Act (DDA) and J&K Public Safety Act (PSA) in force in J&K but at the same time people have various rights enshrined under article 21A and 22A of Fundamental Rights and such rights cannot be overruled by AFSPA , DDA or PSA. He said even under PSA the grounds of the detention should be provided to the affected person within five days and if this not provided we can ask police about the reasons for the same under J&K RTI Act.
Former SSP Javed Riyaz Bedar in his address said that due to political instability, the normal policing suffered a lot in J&K and he hoped that now a new chapter can be started with regard to police reforms in J&K. Syed Ahmad Syed former SSP Srinagar also spoke on the occasion. A unanimous resolution was passed on the occasion regarding implementation of D K Basu guidelines & adhering to section 4 (1) (b) of J&K RTI Act 2009 by police and making all district police offices in J&K as public authorities in addition to DGP’s office so that RTI is implemented in all police stations in letter and spirit.
