Court denies bail to Narco Smugglers

Jammu, November-04 (JNF):- Principal Sessions Judge Jammu Jang
Bhadur Singh Jamwal today dismissed the bail applications of Shabir
Ahmed Mir S/O Lt. Mohd Yousaf Mir, Iftikhar Ahangar S/O Abdul Aziz
Ahangar both residents of Seer Hamdan Tehsil & District Anantnag who
were arrested by the police on October 5, 2011 and recovered Charas 3
KG from them.

Jamwal after hearing advocates Rohit Verma and JA Mirza for the
petitioners and Public Prosecutor Shabir Choudhary for the state, observed that the weight of the charas
is 3.00 kilograms recovered from the possession of petitioners which
is a commercial quantity and the rigors of Section 37 NDPS Act stands
attracted for bail being taken. There is no good ground made out for
allowance of the application. The plea raised by the PP that there is
likelihood that in case the petitioners are released on bail, there is
possibility that they will tamper with the prosecution evidence and
may not be available during the trial. Narcotic peddling has assumed
serious dimensions in the State. Reports of seizing drugs from
peddlers are coming in one after another. The drug mafia has spread
its tentacles in many states and beyond the borders of the State. Some
of the peddlers have a history and their record is maintained any
anti-narcotic branch of the police. Some of the known peddlers were
jailed also but it is amusing that they have been freed and have taken
back to drug trafficking. This raises a serious question about the
efficacy of anti-drug laws. Either the laws are flawed or that the
enforcement cadres are conniving at the entire affair. Drug
trafficking is a serious phenomenon and carries dangerous social
dimensions. The youth get attracted to drugs and this spoils their
lives. It is not enough to launch anti drug drive. More important is
educating the society against the effects of drug addiction. Since
drugs generate huge monies, it leads to imbalance of social
equilibrium and gives rise to vast economic disparity. The government
will need to intensify its anti drug operation mechanism and bust the
mafia and its networks. There is the need of inter-state collaboration
for controlling the menace. With these observations Court rejected the
bail application of both the petitioners.
