CJM sentences three real brothers to 15 days imprisonment

Jammu, January 6
Chief Judicial Magistrate Jammu Mr. Sanjay Dhar today convicted and sentenced to three real brothers namely Surat Singh, Prithvi Singh and Kishore Singh sons of Mohar Singh r/o Shiba under P/S Nagrota, facing trial in a case, which was committed on November 6, 2001.
According to the prosecution case a report was lodged with the P/S Nagrota on November 6, 2001 that the accused attacked the complainant Kartar Singh with lathis, fists and stones when he was going to his land and on his alarm some people gathered on spot and rescued the complainant. On the basis of this report the police registered a case u/s 323/336/341 RPC and started investigation. After completion of the investigation presented charge sheet in the competent Court.
CJM after hearing CPO Maroof Ahmed Manhas and Advocate appearing for the accused persons observed that the prosecution has not examined IO as it was reported that he has died. As per the CPO appearing for the state that accused gave beating to injured Kartar Singh who was about to plough his land situated at Village Shiba. To prove these allegations, the prosecution examined injured Kartar Singh and his wife Usha Kiran and his brother Krishan Singh. RK Tamiri. The prosecution has thus been able to bring home the guilt of the accused and offence u/s 323 RPC is proved against the accused persons and all accused persons are accordingly convicted of offence u/s 323 RPC. On the question of sentence, there is nothing on record to show that accused are having previous criminal background do not deserve the maximum punishment. The accused are sentenced to undergo simple imprisonment of 15 days and to pay fine Rs 5000/- each. In case amount of fine is realized, the same shall be paid to injured,as compensation, CJM ordered.
