| Respondents withheld pension, gratuity and GP Fund of petitioner challenged | | HC directed Chief Conservator of Forest to appear in person | | Jammu, July, 31 :-Justice Nirmal Singh of J&K High Court Jammu Wing in a writ petition filed by a retired employee of forest dept, after hearing petitioner in person, directed Chief Conservator of Forest to appear in person on next date of hearing.
Petitioner Jagdish Chander, who was retired on July 31, 2005, after attaining the age of superannuation whereas he has completed all the documents pertaining pension prior to the date of his retirement.
In the petition it has been submitted that there is a controversy over the date of birth of the petitioner as the date of birth of petitioner according to matriculation certificate was July 18, 1947, but the date of birth was mentioned as July 18, 1946 which was due to clerical mistake as per the petition and according to the petition that the respondents have withheld the pensionary benefits of the petitioner without any reasonable cause and reasons and also withheld the amount of gratuity and have not released the amount of GP Fund, which is the amount of the petitioner.
The petitioner prayed before the Court for issuance of direction to the respondents for fix and release pension, amount of gratuity, GP Fund and all other pensionary benefit in favour of the petitioner. JNF |
