HC asks govt to pay Rs 3 lakh, job to victim’s family

Srinagar, Nov 5 (KNS): The High Court has directed state government to pay compensation of Rs three lakh and employment under SRO 43 to the family of a person who was killed by SOG personnel in custody in 2002.
Justice Mansoor Ahmad Mir while passing the order in the writ petition filed by Parweeza Begum wife of the victim Mohammad Sadiq Kasana directed the government to pay the compensation within three months to the victim family.
“Keeping in view the facts and circumstances of the case I also direct the state government to consider the case of the petitioner No 1 (Parweeza Begum) for compassionate appointment in terms of the provisions of SRO 43 provided the petitioner is eligible,” the court ordered.
“However, the age factor shall not come in the way of the respondents and the same be considered for relaxation while keeping in view the fact that the writ petitioner is before this court right from 9 March 2000,” it added.
The petitioner had pleaded before the court that her husband was killed in custody by the SOG personnel who were stationed at Ganderbal and Somdat Commandant of 119 Battalion CRPF. The petitioner had approached the court after police had refused to file an FIR.
“After investigation, the police came to the conclusion that Jagtar Singh and Hakim Din had arrested the deceased and killed him during custody. It is averred that the said investigation is defective because the IO has tried to shield the SOG personnel especially Somdat Commandant,” the petitioners pleaded.
After investigation by the police it was established that SPO Hakim Din and Dy SP Jagtar Singh, the then incharge SOG Ganderbal were involved in the death of the deceased. “The case was closed as untraced due to the death of the said officer said officers and final report was made in the shape of ikhtitami Final Report No 14 dated 30th of April 2007. They have denied that besides the above two persons there were other SOG personnel also involved in the matter. That the investigation was taken to its logical end and the same is not defective in any way,” it said.
“Admittedly in terms of the report of IO respondents have admitted that investigation was conducted and it was established during such investigation Jagtar Singh and Hakim Din were involved in the death of the deceased the sole bread earner of the victim’s family. This not only has affected their life but has made them very vulnerable to other social evils,” it added.
