Court awards 3 years’ imprisonment and fine of Rs 3000 to Ex-Sarpanch after eight year trial

Jammu, November-05 (JNF):- Judicial Magistrate Akhnoor PK Sharma today awarded three and half years’ imprisonment and fine of Rs 3000/- to Ex-Sarpanch and one year and fine of Rs 1000/- to Dhian Chand who were facing trial along with other five accused for the last eight years whereas the court acquitted Kishore Kumar, Pawan Kumar, Anant Ram and Babu Ram from the charges leveled against them by giving benefit of doubt. Another accused, Partap Chand had died during the trial period..
According to the police there was a dispute over land between both the parties on April 6, 2003, Dr. Tulsi Ram complainant went to his village and some respectable persons were called and told that some persons have to go on spot and inspect the place of occurrence. About six persons of the Mohallla agreed to visit and they reached the spot and asked the Chowkidar to call Sarpanch Raj Kumar and he came on spot in anger and caught hold of Kuldeep Raj S/O Tulsi Ram, rest of the accused also started beating complainant and the complainant was injured and admitted in hospital. A case was registered and after completion of the investigation Akhnoor police presented challan in the Court.
Court heard PO Anshuman Dubey for the State and advocate VK Sharma for the accused persons.The court also went through the arguments and the court come to the conclusion that prosecution has been able to prove its case against accused Raj Kumar then Ex-Sarpanch and accused Dhian Chand and awarded sentence to Raj Kumar Ex- Sarpanch u/s 325/34 RPC to undergo 2 years imprisonment and fine of Rs 1000/-, he was further convicted u/s 324 RPC and awarded one year imprisonment & fine of Rs. 1000/-, he was also convicted for a period of six months u/s 323 with fine of Rs 1000/-. The total fine imposed on accused Raj Kumar is Rs 3000/- and all the sentences shall run concurrently, court ordered. Regarding accused Dhian Chand court observed that keeping in view the age of 55 years and health condition of accused Dhian Chand is given lesser punishment and was awarded imprisonment of one year and fine of Rs 1000/-.
