Anti-corruption court grants bail to Govt employees involved in cheating case | | | EARLY TIMES REPORT Jammu, November-05 :- Special Judge Anti-corruption Jammu Pawan Dev Singh Kotwal today granted conditional bail to Noor Hussain and Mohd Farooq Bhat who were arrested by the police in a cheating case. According to the police report the applicants have been booked for the offences u/s 5(2) PC Act 2006 r/w section 420/161/120-B RPC for receiving illegal gratification of Rs 10,000 from the complainant for engagement of his wife as a helper in Anaganwari but was not allowed to join despite the order issued. The court after hearing advocate Ajaz Choudhary for the accused applicants whereas CPO for the state, observed that accused are in custody for last three days and therefore, the requirement of investigating agency of custodial interrogation as submitted by CPO seems to have been met. The police further revealed that investigation of the case is almost complete and therefore the prosecution has failed to make any ground for further custody of the accused. Accused are public servants and therefore, question of their jumping over the bail does not arise. Court is also of the opinion that in the given circumstances further custody of the applicants is at the cost of their fundamental right of personal liberty. With these observations the court granted conditional bail to the both applicants with the direction to furnish bail bond and personal bond to the tune of Rs 30,000 with the condition imposed by the Court.
