HC stays new recruitment policy

srinagar, Nov 5: The new recruitment policy announced by the state government was stayed by the High Court on Saturday.
The order was passed by Justice Hasnain Masoodi in the writ petition filed by one Ghulam Nabi Dar of Hazrtbal against the state. While admitting the petition, Justice Masoodi asked the government to file its objections within three weeks. Advocate Jehangir Ganie appeared on behalf of the petitioner while Advocate General Mohammad Ishaq Qadri appeared on behalf of the state.
Advocate General said that the petitioner has challenged the government order on the grounds that it 'violates his fundamental rights and is discriminatory and unreasonable.' After hearing both the counsels the court admitted the petition for hearing and has meanwhile kept the order dated 27-10-2011 in abeyance till objections are filed and considered," he added.
The state government recently passed recruitment policy order number 257/S of 2011 under which a fresh recruit would only get 50 per cent of the basic pay for the first two years and 75 per cent for the next three years without any allowances.
The cabinet had recently approved the modalities for switching-over to "Fixed Salary Mode" of recruitment in Jammu and Kashmir under which the new fresh non-gazetted recruits shall be paid fixed monthly salary equivalent to 50 percent of the basic pay (Pay Band+Grade Pay) for the first 2-years at the minimum of the Pay Band.
For the next 3-years or during the remaining period out of total five years (if the period of probation has been extended) such an employee would be entitled to receive fixed salary of about 75 percent of the basic pay (PB+GP) at minimum of the Pay Band.
