Report unlikely to address external dimensions of K-issue | | | Even the political analysts and the constitutional experts admit that the very Article 370 of the constitution of India,that provides to Jammu and Kashmir state a special staus within the union of India,has been instrumental in promoting a feeling among the people of the border state that they are a class apart from people of other states.This very Article has given a sense of exclusivity among the people,especially among those belonging to the Kashmir valley.Rightly or wrongly people have been led to believe that as a result of the cover provided by Article 370 they are their masters who have the right to decide their future.It is because of this belief that people in the valley greet any move to dilute the spirit of Article 370 with utter disgust and anger.Since the very essence of Article 370 has been misunderstood and misinterpreteded it has given scope to a section of people in the valley to join hands with the separatists demanding either Azadi for the state or its incorporation with Pakistan.And whenever efforts were made and are being made to facilitate people in Kashmir to join the national mainstream they are being frustrated by those who swear by the name of Article 370. And this way it is irony of fate that the three interlocuters,appointed by the Government of India for recommending measures that could address the external and internal dimensions of the Kashmir issue,have favoured restoration of autonomy..If reports doing rounds are to be relied on the interlocuters have favoured strengthening the original spirit of Article 370 and whereever some erosion has taken place that should be corrected.They have recommended it without realising that this very Article had given rise to not only separatism but to regional and subregional conflicts and passions.You have people in the valley seeking restoration of the original spirit of Article 370,you have people in Jammu favouring scrapping of this constitutional provision,you have people in Kargil district wishing to have no links with the people in Leh district,you have people in Poonch and Rajouri besides the one in Doda,Kishtwar and Bhaderwah clamouring for hill development councils.If the interlocuters believe that restoration of autonomy,repeal of all the central laws applied to the state after 1953 can resolve internal problems in tthe state they are mistaken.Yes restoration of autonomy could give a feeling of achievement to a section of people in the valley but it may revive the demand for reorganisaion of the state in three separate states in Jammu and Ladakh. Interlocuters are said to have recommended setting up of three separate councils for Kashmir,Jammu and Ladakh.It is a good idea provided these councils are not forced to play the second fiddle to the state legislature.It has to be made clear whether these councils will be made subservient to the state legislature or given full constitutional and financial powers for shaping the destiny of people in each region.When the National Conference sponsored committee had recommnded repeal of those central laws that were extended to the state after 1953 and were not in the interests of the people of the state one of the members of the Committee had put it on record that the arms of the clock cannot be reversed.In the background of this development the interlocuters have recommended setting up of a constitutional committee to review all the central Acts and Articles that were extended to the state after 1952 Delhi Agreement.Is the jurisdiction of the Supreme Court,Election Commission of India and the Comptroller and Auditor General of India in Jammu and Kashmir to the interest of people or they simply jeopardise their rights and freedom? Will restoration of pre-1953 constitutional status promote peace and normalcy in the state ?It would be better for the Government of India to take into account these very two questions before taking any decision.The Government should be more concerned about the external dimensions of the Kashmir issue which requires sustained dialogue with Islamabad and Kashmiri separatists.Above all the Govrnment needs to set up new delimit ation commission that could dilute or reduce the level of regional imbalance. |
