HC quashed the order of discharged from service after 7yrs | | | EARLY TIMES REPORT Jammu, Nov 13: Jammu & Kashmir High Court Jammu Wing quashed the impugned order responding to a petition filed by Ajit Singh Yadav who was discharged after seven years with the direction that the period for which the petitioner was out of service will be dealt with authority in accordance with rules and decision taken within 12 weeks from the date copy of this order is served upon the authority. Justice Muzaffar Hussain Attar of Jammu & Kashmir High Court Jammu Wing in a petition filed by Ajit Singh Yadav who was enrolled in the Indian Army on April 9, 2002 and came to be discharged from service by the Commanding Officer on October 3, 2004 on the ground that his verification of character and antecedents was found unsatisfactory, quashed the impugned order with the direction that the period for which the petitioner was out of service will be dealt with authority in accordance with rules and decision taken within 12 weeks from the date copy of this order is served upon the authority. In the petition it was challenged that the discharge from service of the petitioner on the basis that a criminal complaint was lodged against the petitioner. During the pendency of the petition the trial Court acquitted the accused of the charges leveled against him. Adv RK Bhatia appeared for the petitioner submitted that discharge order of petitioner from service that there was allegation against him which was required to be proved at Trial. The Trial Court after concluding trial has acquitted the petitioner of charges leveled against them. Justice Muzaffar Hussain Attar while allowing the petition quashed the impugned order dated October 3, 2004 with the direction to the authority. (JNF)
