Court rejects bail plea of accused facing ‘murder case’

Jammu, Nov13: Principal Sessions Judge Jammu today rejected the bail application of accused facing trial in a murder case along with other accused.
Principal Sessions Judge Jammu Jang Bhadur Singh Jamwal rejected the bail application of accused Rajesh Kumar who is facing trial in a murder case along with other accused.
While rejecting the bail application Principal Sessions Judge Jammu Jang Bhadur Singh Jamwal after hearing Public Prosecutor Shabir Choudhary for the State whereas Adv JA Hamal for the petitioner observed that the facts attending the occurrence are that the police received an information from reliable source that one male dead body wrapped in plastic sheet is lying in the bank of Ranbir Canal near KC Door.
Case file reported that on the basis of this information, the police registered the case and commenced the investigation thereupon and during the course of investigation the suspect/accused Dinesh Kumar was taken into custody and during questioning, he confessed his involvement.
It was also revealed that later on the deceased had been identified as Sajjad Sawar Khan after killing him accused Dinesh Kumar shifted the body of deceased from his shop located at Top Sherkhania to Muthi and throw it on the bank of Ranbir Canal with the help of accused Rajesh Kumar in his vehicle No. JK08A-4949. The accused identified the place of occurrence and forensic expert were called for spot inspection. The accused has been charge sheeted U/Ss 302/201/109 RPC. At this stage, the charge-sheet submitted by the prosecution has to be relied upon for consideration of bail. Since accused is involved in the commission of offences U/Ss 302/201/109 RPC, the bar stands attracted for bail being taken. Accordingly, Court is satisfied that the petitioner/accused Rajesh Kumar has not made out a good ground for grant of bail in his favour at this stage. With these observations Court rejected the bail application. (JNF)
