Court frames corruption charges against former SE

Jammu, November-14 :- Special Judge Anticorruption Jammu,
Pawan Dev Kotwal today framed corruption charges against Syed Muzaffar
Hussain Shah former Supt Engineer PHE Circle Doda (now retired as Chief
Engineer) u/s 5(2) r/w 5(1) (d) PC Act 2006 and 120-B RPC.
According to the Vigilance case on January/March 2004 when
accused posted as Superintending Engineer, Hydraulic Circle, Doda had
placed orders of stores items worth Rs.20 lacs with fake firms. On
this, a joint surprise check was conducted, during which it surfaced
that accused Syed Muzaffar Hussain Shah, the former Superintending
Engineer, Hydraulic Circle, Doda had placed orders of stores items,
such as pipe wrenches and chain wrenches with eleven firms purportedly
of Doda and Kishtwar Towns costing/amounting to Rs.14,26,817/- for
Public Health Engineering Division of Doda and Kishtwar for the year
2003-04. On the basis of documentary and oral evidence collected
during the course of JSC a case FIR No.23/2006 U/S U/S 5 (2) J&K PC
Act Svt. 2006 read with Section 120-B RPC was registered at P/S VOJ.
During the course of investigation, it was found that the accused
public servant Syed Muzaffar Hussain Shah, the then SE, PHE Hydraulic
Circle Doda (now retired Chief Engineer) by abusing his official
position acting in league with the accused proprietors conferred undue
pecuniary benefits to the accused proprietors thus causing a loss of
Rs.1, 96,687/- to the state exchequer over purchase of store items on
highly exorbitant rates.
Court also framed charges against one Sheraj Ahmed Shinali
Prop M/S Shinali Brothers Doda an registered firm with sales tax and
labour department in order to get undue benefit by making supply of
store items along with accused other four accused hatched a criminal
conspiracy with then SE PHE circle Doda and in the said conspiracy,
accused Sheraj Ahmed Shinali and other four accused supplied the store
items on the basis of supply order placed by then SE PHE Circle Doda.

The court after hearing CPO Parshtom Sharma appearing for the VOJ issued
non-bailable warrants against Javed Iqbal Sheikh, Tahir Jameel Bhat,
Nusrat Jehan Ara and Haq Nawaz Nehru. JNF
