| HC dismisses 2 petitions | | Transfer of JEs | | EARLY TIMES REPORT
Jammu, November-14 (JNF):- The High Court today dismissed two petitions challenging transfer of Junior Engineers from R&B to RDD.
Justice Muzaffar Hussain Attar
after hearing the parties observed that The Article 22-D provides
that deputation covers appointments made by transfer of in-service
Government Servant in public interest outside their parent
organization on temporary basis. The statutory rule thus makes the
expression transfer and deputation akin to each other and authorizes
the competent authority to make temporary reputation of its employees.
With these observations court dismissed the petition.
The petitions filed by Ghulam Abbas Vs State of J&K Ors & Surinder Mohan Gupta and ors Vs State of
J&K Ors challenging transfers orders of Junior Engineers (civil)
grade-II Public Works Department to the Rural Development Department,
Jammu vide order dated October 29, 2010 seeking quashment of the
orders on various grounds.
