Politicians grab prime land | DB directs AAG to submit report | | EARLY TIMES REPORT Jammu, November-16 (JNF):- The Division Bench of the High Court comprising Chief Justice FM Ibrahim Kalifulla and Justice Virender Singh in a Public Interest Litigation on land grab by politicians has sought detailed report from AAG. The petition filed by Professor SK Bhalla regarding alleged encroachment of land worth crores of rupees by the Politicians, has directed AAG AH Qazi that he shall get necessary instructions from the concerned authorities with reference to the statements contained in the two annexure and submit his report on the next date of hearing. While directing the AAG, the court after hearing the parties observed that though this Public Interest Litigation having heard counsel for the petitioner, “We find that issue can be narrowed down to two of the matters referred in the annexure B and V” and directed the Registry to list after three weeks. According to annexure B a letter written by the PHQ to Divisional Commissioner Jammu whereby requested that any police action warranted may accordingly be initiated regarding encroachment of land worth crores of rupees allegedly encroached by top police officers/politicians. According to the annexure V, the settlement officer Jammu in the monthof October, 2007 addressed a letter to Minister of State for Finance,Planning, Revenue, Law& Parliamentary Affairs regarding petition of Tilak Raj & Ors in terms of section 27 of the Land Revenue Act, 1996 BK in which the settlement officer submitted that kindly refer your endorsement dated March 8, 2007 on the case Titled Tilak Raj & Hem Raj sons of Karam Chand Vs Shabnam Taj, Nousheen, Arshi Tajdaughters of Taj Mohi-ud-Din instituted before your court in terms of 27 of land revenue act, whereby enquiry report in the matter was sought, the report in the matter was sought from Tehsildar Jammu settlement which has been received on September 28, 2007, the perusal of the reports reveals that in the name of three daughters of Taj Mohi-ud-Din have been recorded as per the spot position whereat present also the said Khasra measuring 342 Kanals 4 Maralsi is under the possession of non-applicant. The fact which is agreed to by the owners as well as the inhabitants of the said village. In the PIL the petitioner highlight a brazen case of land grabbing of proprietary land of two brothers namely Tilak Raj and Hem Raj sons of Karam Chand r/o Chak Lalu Shah Tehsil & District Jammu whose land measuring 342 Kanals 4 Marals has been allegedly encroached by none else than the 3 daughters of a Cabinet Minsiter namely Taj Mohi-ud-Din Minister for PHE, Irrigation and Flood Control. It has been further submitted that both the brothers are pitted against the daughters of minister as such there efforts did not materialized to get VVIP’s encroachers evicted from their duly owned proprietary land. It was alleged that daughters of minister have raised a Big Farm House on said land and adjoining land for leading luxurious life and various reports of the Revenue Agency could not deter them and rightly so in view of the clout of their father a cabinet minister. The petitioner submitted that a copy of the report of settlement officer Jammu dated October 11, 2007 which is self explanatory and shows the plight of the owners and strength of the three daughters of powerful minister and seeking direction Chief Secretary, Financial Commissioner Home, Commissioner/Secretary GAD and Commissioner/Secretary Revenue Dept to constitute a Special Investigating Team comprising Officer proven integrity from State Vigilance Organization and Revenue Dept to probe allegations of land grabbing leveled against certain police officers, politicians and bureaucrats.
