| XEN acquitted of corruption charges | | | EARLY TIMES REPORT
Jammu, November-17:- Special Judge Anticorruption Jammu Pawan Dev Kotwal has acquitted Sher Mohd Khan the former Incharge Xen REW
Doda who was facing trial on the complaint of then Xen Engineering Wing Vigilance Organization Jammu.
According to the case on February 24, 2006 complainant Bharat
Bhushan Sharma then Xen Engineering Wing Vigilance Organization Jammu
lodged a written complaint at P/S VOJ, alleging that a few months back
in a joint surprise check he had conducted inspection of works of
roads constructed under PMGSY. The works were found executed by then
Incharge Xen Sher Mohd Khan and report in this matter had already been
submitted. That on February 24, 2006 at about 9:15 hours Sher MOhd
Khan accompanied by the one Mantoo JE came to his residence and asked
the complainant to favour him with regard to inspection of works. The
complainant straight way refused for conferring and any favour also
told him that the relevant report has already been submitted. On this
Sher Mohd Khan again asked the complainant for favour and offered him
a packet. The complainant refused to accept the same but Sher Mohd
Khan forcibly kept the packet on a chair in his house and hurriedly
left the house of the complainant. The complainant came out of the
house chased him for returning him the packet but he left the spot. On
checking the packet he found amounting Rs 20,000/-. On this complaint
a case u/s 165(A) RPC r/w section 5(3) of J&K PC Act was registered
and investigation was commenced. After completion of investigation VOJ
presented the challan.
While acquitting the accused, the court after hearing the parties
observed that investigating officer concluded that a joint surprise
check was conducted into the allegations of fraudulent withdrawal of
amount worth lacs of rupees by the Rural Development Dept Doda against
non-existing works of construction of roads. During the JSC by the
engineering wing of VOJ, Incharge Xen REW Doda Sher Mohd Khan was also
associated who identified the works during the inspection. Some of the
works against which the amount was drawn were found not executed.
Verification report was submitted by then Xen Engineering Wing to SSP
for further necessary action. Accused XEN was examined wherein he
admitted the inspection of works by Vigilance Team on the Nishandehi
of his staff and in his presence, but submitted that works had been
executed during the tenure of his predecessor Xen Sita Ram and
non-existing work was found. He further submitted that complainant had
called him at his house to enquire about the work of a lane near his
house, but he showed inability to execute the work for want of funds,
the complainant was annoyed and said that he is XEN in VOJ and would
implicate him. He categorically denied that he asked complainant for
any favour and complainant on the basis of personal enmity lodged a
false complaint. He never gave any bribe money to the complainant and
he has been implicated falsely. Court referred various judgments and
further observed that prosecution has failed to established charge
against the accused beyond every shadow of doubt and therefore given
benefit of doubt to him and accused is acquitted of the charges
leveled against him. JNF
