Court awarded life-imprisonment for committing murder | | | EARLY TIMES REPORT Jammu, Nov19 : 1st Additional Sessions Judge Jammu today awarded rigorous life-imprisonment to one Harmeet Singh an accused facing trial for committing murder of Amarjeet Singh on the basis of past rivalry. 1st Additional Sessions Judge Jammu KS Parihar awarded rigorous life-imprisonment to Harmeet Singh @ Meetu r/o Simbal Morh Tehsil RS Pura who was facing trial for the last more than 10 years for committing murder of Amarjeet Singh on the basis of past rivalry. Awarding sentence 1st Additional Sessions Judge Jammu K S Parihar after hearing APP Harpal Singh appearing for the state observed that from the perusal of the medical record produced by the jail authority pertaining to the treatment of the accused in jail, it is revealed that accused has received treatment as a case of fit disorder (seizure disorder) since October 1999 and as per the report furnished to this court, the board of Doctors of Psychiatric Hospital after examination in year 2003 have opined that the accused is suffering from epilepsy disorder and is continuously receiving treatment and is showing sings of improvement as well. Therefore, keeping in view the age of the accused and his mental illness relating to Epilepsy disorder, Court is of the opinion that the present case does not fall in the category of rarest of rare cases and ends of justice would be served if a sentence of rigorous imprisonment for life is imposed upon him under Section 302 RPC. The accused is accordingly sentence to a rigorous imprisonment for life and a fine of Rs.10,000/- under Section 302 RPC. According to the police case that on March 30, 2001 complainant Surjeet Singh lodged a verbal report in Police Station Miran Sahib stating therein that at around 9.00 PM accused Harmeet Singh alongwith accused Amar Nath on the basis of past rivalry has stabbed his real brother Amarjeet Singh with a Kirch in his stomach, as a result of which, his brother has sustained serious injuries who is lying in a pool of blood at the place of occurrence at Simbal Morh near the shop of a Patwari. On April 1, 2001 deceased was succumbed to injuries and a case u/s 302/ 4/25 Arms Act was registered. After completion of the investigation and on the basis of the evidence collected by the investigating agency, the involvement of accused Amar Nath was not found made out and the present challan was preferred only against the accused Harmeet Singh.
