Speaker says no 'hurry' in disqualification decision | Speaker says no 'hurry' in disqualification decision | | Saroj Razdan Jammu, Nov 19: A day after BJP announced disqualification of its 6 MLAs on charges of cross voting and violating the whip of the party during LC polls, while the political corridors are rife with different speculations of the political fallout, the Speaker of the Assembly Mohammad Akbar Lone has ruled out taking such action desired by the party leadership that would deprive them of the membership. Speaker said he would consult legal experts as to how it could be ascertained whether these members have violated the whip and voted against their party candidate. "It is so easy a decision for me to announce…………we are examining the matter afresh and will go to legal as well as constitutional aspects so that we are able find out whether the six MLAs have violated the party whip…..", Speaker said while speaking to Early Times. The scene is not clear in terms of the charges leveled against the group, said the Speaker . " It is a secret ballot….the voting was not open and therefore it cannot be easily established who has voted in favour or against whom……", Lone , who is himself also a legal expert said, in support of his point. I have to establish everything clear before taking any such action, he asserted. In support of his argument the Speaker contended that had the things been clear in terms of establishing the identity of the MLAs who indulged in cross voting and had there been what he termed as 'substantial proof or evidence', as claimed to have determined by the party leadership, he (Speaker) would have then be left with no option other than agreeing to what (disqualification) they have sought. "But it is not that easy….", he maintained. The Speaker in whose court the ball lies now after BJP leadership sent a copy of the decision , said he has received it. However, he indicated he was in no hurry to 'accept or agree' to what party has sought , and also attributed this to the fact that the matter is subjudiced , pointing out to the matter being contested by Prof Chaman Lal Gupta in the court. He contended though it is only Prof Gupta who is contesting the party decision, it is applicable to others as well. "Prudence demands I should look into that aspect also", Lone observed. In what now appears the matter may take long before settling it down outrightly, the Speaker also said apart from discussing the matter with Advocate General and other constitutional luminaries, he would not skip what he stated as a mandatory step in terms of delivering justice- issuing notices to all six against whom party has announced disqualification as members to know what they have say in the matter in the aftermath of party's decision. " I need to know what are their comments and observations…..I must hear and listen to their side of the story as well ……without that I cannot announce anything", he added. |
