Life imprisonment awarded in murder case after 12 years Trial

Jammu, Nov 21: Principal Sessions Judge Jammu today awarded rigorous life-imprisonment and fine Rs 10,000 to one Lokesh Sharma @ Pappu of Gangyal Jammu for committing murder of Ujagar Ram s/o Bua Ditta about 12 years ago.
Principal Sessions Judge Jammu Jang Bhadur Singh Jamwal after hearing PP Shabir Choudhary for the state and referred various judgments observed that Court agree with the defence counsel and rely upon the aforesaid cases apart from the extenuating factors and disagree with the plea raised by the PP that this is a case falling within the category of ‘rarest of rare case’.
Court agree the pleas raised by defence counsel that the accused was youth of 19yrs
at the time of occurrence, is only bread earner of the family having no previous record of crime also. The counsel finally has prayed that the case does not fall within the category of rarest of rare case which calls for imposition of capital punishment on the accused/convict. In view of the guidelines issued by Apex Court and seeking the nature of case, age and social and economic status, this case does not fall under the category of Rarest of Rare Case and awarded rigorous imprisonment for life and a fine of Rs.10,000 to Lokesh Sharma.
According to the police case Rano Devi wife of deceased Ujagar Ram, accompanied by her son Rinku Kumar and her husband in an injured condition made oral report that accused Lokesh Sharma son of Om Parkash nourishing an enmity with her husband since long attacked Ujagar Singh. According to case the woman saw Lokesh Sharma alias Pappu inflicting injuries with kirch to her husband with intent to kill him which struck him near stomach. Her husband fell down on the ground in a pool of blood. The occurrence has been seen by other persons also. Police registered a case u/s 302 RPC and after completion of the investigation Challan was presented in the Court.
